The Emergency Medical Treatment and Labor Act (EMTALA) is a nearly 40-year-old federal law requiring hospitals to provide treatment for emergency medical complications. On April 24th, SCOTUS is hearing a consolidated case (Idaho v. United States and Moyle v. United States) that challenges decades of legal precedent. Politicians who oppose abortion are trying to ignore decades of legal precedent and exclude pregnant people from EMTALA’s protections – despite the fact that federal law supersedes state laws banning abortion.
